Terms of Service

1. Who we are

GrowBy is a Meta (Facebook and Instagram) advertising and ad-creative service run by GrowBy, Klaipėda, Lithuania. Contact: growby.eu@gmail.com.

2. Services

• Free ad audit: a one-time written review of your ads or social profile with suggested improvements. Free, no obligation.
• Paid plans (Starter, Growth, Pro): ad creative production, campaign setup and management in Meta Ads Manager, Meta Pixel and tracking setup, testing and reporting, as described on growby.eu at the time of purchase.

3. Ad budget

Your advertising budget is not included in the plan price. You pay it directly to Meta through your own ad account and payment method. GrowBy never holds or pays your ad budget.

4. Price and payment

Plans are billed monthly in advance as a subscription through Stripe. The price is the one shown on the payment page you receive from us. Any first-month discount applies only to the period stated on that page. Stripe sends a receipt for each payment.

5. Start of work

Work starts after the first payment and after you give us the access we need (e.g. partner access to your Meta Business account, Page and ad account) and the materials we ask for. Delays caused by missing access or materials don't extend our deadlines.

6. Cancellation

There is no long-term contract. You can cancel at any time by emailing growby.eu@gmail.com. Cancellation takes effect at the end of the current paid month; you won't be charged again. We may end the service with 14 days' notice by email.

7. Refunds

Because work (creative production, campaign setup) starts right after payment, payments for a month that has started are not refundable. If we fail to deliver the services described in your plan for that month through our fault, contact us and we will either deliver them or refund the affected month in full or in part. This does not limit any rights you have under mandatory consumer law.

8. No guaranteed results

Advertising results depend on many factors outside our control (your offer, prices, website, market, Meta's algorithm and policies). We commit to doing the work described in your plan carefully and reporting honestly, but we do not guarantee specific sales, leads, costs or returns.

9. Your responsibilities

• You confirm you have the right to advertise your products or services and that the information and materials you give us are accurate and lawful.
• You approve ad texts and creatives before they go live, unless agreed otherwise.
• You are responsible for complying with Meta's advertising policies regarding your business and offer. Meta may reject ads or restrict accounts; we will help resolve this but cannot control Meta's decisions.

10. Creatives and intellectual property

Once the relevant month is paid, you may use the ad creatives we made for you for your business without time limits. We may show anonymised or, with your permission, named examples of our work in our portfolio. Materials you provide remain yours.

11. Liability

Our total liability for any claim related to the services is limited to the amount you paid us in the 3 months before the claim. We are not liable for indirect losses such as lost profit, or for losses caused by Meta, Stripe or other third-party platforms. Nothing in these terms limits liability that cannot be limited by law.

12. Changes

We may update these terms. The date at the top shows the latest version. Changes to the price of an active subscription will be announced by email at least 14 days in advance.

13. Law and disputes

These terms are governed by the law of the Republic of Lithuania. We will try to resolve any dispute by talking first. Consumers may also contact the State Consumer Rights Protection Authority (vvtat.lt) or use the EU ODR platform (ec.europa.eu/consumers/odr).
